Village Beach Club Membership Agreement, Rules & Policies
This Membership Agreement, Rules & Policies (“Agreement”) is entered into on an annual basis between Village Beach Club (“Club”) and the undersigned member (“Member”). This Agreement is intended to balance a welcoming, hospitality-focused club atmosphere with clear expectations, safety standards, financial responsibilities, and operational flexibility.
1. Nature of Membership
Membership at Village Beach Club provides Members with access to select amenities, programs, and experiences during the applicable membership year. Membership does not convey ownership, equity, or property rights in the Club. Membership privileges are personal, non-transferable, and subject to this Agreement and posted Club policies.
2. Annual Term & Renewal
Memberships are issued on an annual basis and expire at the end of the membership year unless renewed. Renewal is not automatic and may be subject to revised pricing, benefits, rules, or policies adopted for the subsequent year.
3. Membership Acceptance, Initiation Fee & Payment Structure
Upon notification of acceptance, Members are required to remit payment of all required membership fees. A one-time, non-refundable initiation fee may apply and will be subject to applicable sales tax. Annual membership dues are required to be paid in full for the applicable membership year unless otherwise approved in writing by the Club.
4. Billing, Monthly Charges & Unpaid Balances
- Certain charges incurred by Members may be billed on a monthly basis and are due upon receipt. Past-due balances may be subject to late charges as permitted by North Carolina law.
- Failure to bring an account current within applicable notice periods may result in suspension of access to Club facilities until payment is received in full.
- Members must maintain a valid ACH or credit/debit card authorization on file. Returned or declined payments may result in suspension of privileges.
- If an account is referred for collection, Members agree to be responsible for reasonable attorneys’ fees and collection costs as permitted by law.
5. Assumption of Risk
Member understands that use of Club facilities—including pools, beach and ocean access, cabanas, bars, dining areas, furnishings, walkways, fitness facilities, and parking areas—involves inherent risks including water hazards, weather conditions, slips, falls, physical exertion, and alcohol-related risks. Member voluntarily assumes all such risks for themselves and their guests.
6. Pool & Water Safety
- The Club may provide lifeguards at certain times. HOWEVER, ALL POOL AND WATER USE IS AT YOUR OWN RISK AT ALL TIMES.
- Members and guests must behave as though no lifeguard is on duty and remain responsible for supervising children and guests at all times.
- Pool seating and chairs are not guaranteed and are available based on availability. Club staff may deny or reassign seating based on safety, events, or operational needs.
- The Club reserves the right to restrict or close pool and water areas due to weather, safety concerns, staffing, maintenance, or private events.
7. Beach Access & Amenities
During business hours all members and guests are required to enter the club via the main entrance and check in with staff. After hours beach access apart from private events may be available via the beach access gate. Beach chairs and umbrellas may be provided for a fee or based on membership type and availability. Availability is not guaranteed and may vary based on season, demand, or events. All beach equipment owned or leased by the Village Beach Club is subject to use restrictions and additional fees may apply.
8. Alcohol Service & Responsibility
Alcoholic beverages may be served in accordance with applicable law. Consumption is voluntary. Members acknowledge responsibility for their own conduct and the conduct of their guests. The Club reserves the right to limit or refuse alcohol service to maintain safety, compliance, and guest experience.
9. Guests, Dependents & Household Responsibility
- Members are responsible for ensuring that all guests, dependents, and authorized users comply with this Agreement and posted rules.
- Guests must be accompanied by a Member unless otherwise authorized. Members are financially responsible for charges, damages, excessive cleanup, or violations caused by their guests.
10. Child Supervision Guidelines
- Village Beach Club is an adult-focused membership program that remains welcoming to children.
- Children under the age of 8 must be actively supervised by an adult who can see and hear the child at all times.
- Children ages 8–15 must be accompanied by an adult member who remains on Club premises.
- Parents or guardians must remain on the premises while their children are present.
11. Furniture, Seating, Cabanas & Premium Areas
- Certain furniture, seating areas, cabanas, and premium spaces are designated for specific uses and may not be moved or rearranged.
- Only Club staff may relocate furniture in designated areas.
- Assigned seating may be implemented during peak periods or events.
- Cabana use, reserved seating, or premium areas require advance reservations and additional fees.
12. Private Events, Closures & Special Programming
- The Club may host private events, member events, or special programming that may limit access to certain amenities.
- Facilities may also close temporarily due to weather, maintenance, staffing, or operational needs.
- Certain events or experiences may require additional fees, reservations, or minimums.
13. Conduct, Courtesy & Staff Authority
- Members and guests are expected to conduct themselves in a respectful and safe manner.
- Members and guests must follow reasonable instructions from Club staff related to safety, operations, or guest experience.
- Disorderly or unsafe conduct may result in removal from the premises for the day and may impact future membership eligibility.
14. Mobile Devices
To preserve a relaxed Club atmosphere, Members are expected to use mobile devices with discretion and awareness of their surroundings.
15. Care, Cleanliness, Smoking & Property Use
- Members are expected to leave Club facilities, furniture, and amenities in a clean and orderly condition.
- Excessive cleanup, damage, or misuse of Club property may result in additional charges.
- Smoking is prohibited on Club property except in areas expressly designated by the Club, if any.
- The Club is not responsible for lost, stolen, or damaged personal property.
16. Outside Trainers, Classes & Fitness Participation
- The use of non-Club trainers, coaches, therapists, or service providers on Club property is prohibited.
- Members should arrive on time for classes and workshops and communicate with instructors regarding injuries or limitations.
- All fitness activities are undertaken at the Member’s own risk.
17. Animals & Dress Code
- Pets are not permitted on Club property, including pool and beach areas, with the exception of qualified service animals.
- Appropriate attire and footwear are required at all times. Closed-toe athletic footwear is required in fitness areas.
18. Hours of Operation
Membership access is permitted during posted hours of operation, which may be modified due to weather, events, maintenance, or operational needs.
19. Membership Policies & Entire Agreement
This Agreement, together with posted Club rules, schedules, and written addenda adopted from time to time (collectively, the “Membership Policies”), constitutes the entire agreement between the Club and the Member.
20. Sex Offender Representation
Member represents that neither they nor any authorized user under their membership has been convicted of a sexual offense or is required to register as a sex offender.
21. Photography, Video & Marketing
Members acknowledge that Club activities and events may be photographed or recorded. Members grant the Club a non-exclusive, royalty-free license to use their likeness in any media for marketing or promotional purposes without compensation.
22. Waiver of Liability & Assumption of Risk
- To the fullest extent permitted by North Carolina law, Members release and hold harmless the Club, its owners, employees, affiliates, and agents from claims arising from use of the facilities, including claims based on ordinary negligence.
- Members acknowledge responsibility for their physical condition and assume the risks of participation in fitness or recreational activities.
23. Consumer Right to Cancellation
- Members may cancel this Agreement without penalty within three (3) days of execution by providing written notice to the Club.
- All membership credentials must be returned and the account brought to zero prior to cancellation becoming effective.
24. Dispute Resolution & Arbitration
- Any dispute arising out of or relating to this Agreement or membership at the Club shall first be addressed through good-faith informal discussions.
- If not resolved, the dispute shall be resolved by binding arbitration conducted in Dare County, North Carolina, in accordance with the rules of the American Arbitration Association.
- Members waive the right to bring claims in court or to participate in class or collective actions.
25. Amendments, Governing Law & Electronic Signature
- The Club may amend this Agreement, rules, schedules, or fees from time to time. Continued use constitutes acceptance.
- This Agreement shall be governed by the laws of the State of North Carolina.
- Electronic signatures are deemed valid and binding.
